이용약관 (Terms of Service)

제 1 조 (목적 및 정의)

본 약관은 Quant Bot(이하 "회사")이 제공하는 암호화폐 자동매매 소프트웨어 프로그램(이하 "서비스")의 이용과 관련하여 회사와 사용자(회원) 간의 권리, 의무, 책임 및 기타 필요한 사항을 명확히 규정함을 목적으로 합니다.

가상자산(암호화폐): 거래소에서 전자적 형태로 거래되는 디지털 자산을 의미합니다.
퀀트 봇(Quant Bot): 지정된 알고리즘과 수학적 지표를 기반으로 국내외 암호화폐 거래소의 API를 통해 매수, 매도, 익절, 손절 등의 주문을 100% 자동으로 수행하도록 설계된 컴퓨터 소프트웨어를 의미합니다.
API Key: 봇이 사용자의 거래소 계정에 접근하여 시스템적인 거래 지시를 내릴 수 있도록 암호화폐 거래소에서 공식적으로 발급하는 고유 인증 암호 텍스트를 의미합니다.

Article 1 (Purpose and Definitions)

These terms define the conditions, procedures, rights, and obligations between Quant Bot ("Company") and the user ("User") regarding the automated cryptocurrency trading software ("Service").

Virtual Asset: Digital assets traded electronically on an exchange.
Quant Bot: Auxiliary software that automatically executes buy/sell orders via Exchange APIs based on preset algorithms.
API Key: A unique credential issued by the exchange allowing the bot to execute orders on the User's behalf.

제 2 조 (서비스의 성격 및 소프트웨어 제공의 한계)

회사가 제공하는 "퀀트 봇"은 투자자의 매매 과정을 기술적으로 보조하고 자동화하는 소프트웨어 도구(Tool) 및 프로그램일 뿐입니다. 회사는 대한민국의 관련 법령에 따른 유사투자자문업, 투자자문업, 자산운용업, 일임매매업 등을 영위하지 않습니다.

회사는 사용자의 자산을 직접 수신, 보관, 대리 운용하지 않으며 사용자의 거래소 계정 내에서만 API를 통해 신호가 전달됩니다.
회사는 특정 암호화폐에 대한 투자 추천, 종목 상담, 시장의 방향성(Long/Short)에 대한 어떠한 형태의 직접적인 조언이나 지시도 제공하지 않습니다.
웹사이트나 커뮤니티에 공개된 봇의 과거 수익률, 시뮬레이션 결과, 백테스트 데이터는 프로그램의 로직을 설명하기 위한 참고 자료일 뿐, 어떠한 경우에도 미래의 확정적 수익을 보장하거나 약속하지 않습니다.

Article 2 (Nature and Limits of Service)

This Service is strictly a software tool designed to technically automate trades. The Company does NOT provide investment advisory, asset management, or discretionary trading services.

The Company never receives, holds, or manages User funds. All actions occur strictly within the User's exchange account via API.
The Company does not provide direct advice, coin recommendations, or market direction predictions.
Past performance, backtest data, and simulations are for illustrative purposes only and in no way guarantee future profits.

🚨 제 3 조 (투자 위험 안내 및 회사의 면책 조항)

암호화폐(특히 선물 및 마진 거래) 투자는 가격 변동성이 극도로 높으며, 사용자가 투자한 원금 100%를 잃거나 그 이상의 부채(강제 청산, Liquidation)가 발생할 수 있는 고위험 투자 상품입니다. 회사는 다음 각 호의 사유로 인해 사용자에게 금전적, 정신적 손실이 발생하더라도 어떠한 민사, 형사, 행정적 법적 책임도 지지 않으며 일체의 손해 배상을 하지 않습니다. 본 소프트웨어를 다운로드하고 실행하는 즉시, 사용자는 본 면책 조항에 100% 동의한 것으로 간주됩니다.

투자의 최종 의사결정 책임: 봇의 다운로드, 실행, 구동 시작 및 중지, 레버리지 배율 설정, 시드 머니(자본금) 배분 등 모든 매매 설정과 최종 투자 결정에 대한 100%의 권한과 책임은 사용자 본인에게 있습니다. 사용자의 판단 오류나 봇의 로직 오인으로 인한 손실은 회사와 무관합니다.
알고리즘 및 기술적 한계: 어떠한 퀀트 알고리즘도 100% 완벽할 수 없습니다. 일명 '빔(Beam)'으로 불리는 1초 단위의 초극단적 시장 폭락/폭등 현상, 플래시 크래시(Flash Crash), 거래소 호가창 비어있음, 비정상적 슬리피지(Slippage) 발생 시 봇의 방어 로직이나 손절 시스템이 시장 속도를 따라가지 못하여 발생하는 강제 청산 및 손실.
해외 거래소 시스템 장애: 바이빗(Bybit), 바이낸스(Binance), OKX, 비트겟(Bitget) 등 API가 연동된 제휴 거래소의 자체적인 서버 다운, 접속 장애, API 통신 속도 지연(Lag), API 호출 제한(Rate Limit 에러), 긴급 서버 점검 등으로 인하여 봇의 매수/매도/익절/손절 주문이 거래소 서버에 정상적으로 도달하지 못해 발생하는 일체의 손실.
사용자 디바이스 및 네트워크 환경 장애: 사용자가 봇을 가동 중인 PC의 전원 차단, 절전 모드 진입, 인터넷 연결 끊김, 와이파이 불안정, 윈도우 OS 업데이트 강제 재부팅, 또는 가상 서버 호스팅(VPS) 업체의 시스템 장애 등으로 인해 봇 소프트웨어가 작동을 멈추어 시장 대응을 하지 못해 발생한 손실.
사용자의 임의 개입: 봇이 구동되며 체결된 주문(포지션)을 사용자가 스마트폰 거래소 앱이나 PC 웹사이트에 접속하여 수동(Manual)으로 취소, 청산, 수정하는 행위로 인해 봇 내부의 계산 로직이 엉켜 발생하는 치명적 오작동 및 손실.
해킹 및 보안 유출: 사용자의 PC가 악성코드, 랜섬웨어, 바이러스 등에 감염되어 거래소 API Key 및 Secret Key가 외부로 유출되거나 탈취되어 발생한 부당한 자산 이동 및 손실.
불가항력(천재지변): 지진, 화재, 홍수, 전쟁, 전력 공급 중단, 국가적 인터넷 망 마비 등 회사가 통제할 수 없는 불가항력적인 상황으로 인한 시스템 마비 및 손실.

🚨 Article 3 (Investment Risks & Absolute Disclaimer of Liability)

Cryptocurrency trading (especially futures and margin) is extremely volatile and involves a high risk of losing 100% of your initial capital (Liquidation). The Company completely disclaims all civil, criminal, and administrative legal liability and will NOT compensate for any financial or emotional losses caused by the following. By downloading and running this software, the User is deemed to have fully agreed to this absolute disclaimer.

Final Decision Responsibility: 100% of the responsibility for downloading, starting, stopping, setting leverage, and allocating capital rests solely with the User.
Algorithmic & Technical Limits: No algorithm is perfect. Liquidations or losses caused by abnormal market speeds, 'Flash Crashes', empty order books, or extreme slippage where the bot's defensive or stop-loss logic cannot react in time.
Exchange System Failures: Losses resulting from unexpected server downtimes, API rate limit restrictions, network lags, or emergency maintenance at partner exchanges (Bybit, Binance, OKX, Bitget) preventing orders from being placed or closed.
User Hardware & Network Failures: Losses caused by the User's PC turning off, entering sleep mode, internet disconnections, forced Windows updates, or failures of third-party Virtual Private Server (VPS) providers.
Manual Interference: Critical malfunctions and losses caused if the User manually cancels, closes, or modifies bot-initiated positions directly through the exchange's mobile app or website.
Hacking & Security Breaches: Unauthorized asset movements or losses due to the User's PC being infected with malware, leading to the theft of API Keys and Secret Keys.
Force Majeure: System paralysis caused by uncontrollable events such as natural disasters, wars, national power outages, or global internet backbone failures.

제 4 조 (사용자의 API 보안 및 관리 엄수 의무)

사용자는 자신의 자산을 스스로 보호해야 할 강력한 책임이 있습니다.

출금 권한 차단: 사용자는 거래소에서 봇 구동용 API Key를 생성할 때 반드시 [Withdraw (출금)] 및 [Transfer (이체)] 권한을 체크 해제(비활성화)해야 합니다. 만약 사용자의 부주의로 출금 권한을 허용하여 해커나 제3자에 의해 자산이 외부로 유출된 경우, 회사는 어떠한 법적 책임도 부담하지 않습니다.
키 유출 방지: API Secret Key는 봇 설정 창에 입력한 후 로컬 PC에 암호화되어 저장될 뿐 회사의 메인 서버로 절대 전송되지 않습니다. 따라서 키 값에 대한 보관 및 관리 소홀로 인한 피해는 전적으로 사용자에게 있습니다.

Article 4 (Strict API Security Obligations)

Users have a strict obligation to protect their own assets.

Prohibition of Withdrawal Access: Users must strictly uncheck and disable the [Withdraw] and [Transfer] permissions when creating their API Keys. The Company is completely absolved of any liability if funds are stolen because the User carelessly enabled withdrawal permissions.
Key Leakage Prevention: API Secret Keys are only stored locally and never sent to the Company's servers. All damages from lost or stolen keys lie entirely with the User.

제 5 조 (국가별 규제 및 제휴 거래소 정책 준수)

본 서비스는 글로벌 암호화폐 거래소의 인프라 위에서 구동되므로 외부 요인에 의해 서비스가 중단될 수 있습니다.

사용자는 거주하는 국가의 법률과 이용 중인 암호화폐 거래소(Bybit, Binance, OKX, Bitget 등)의 독자적인 이용약관, 신원인증(KYC) 규정, 트래블룰 제도를 본인의 책임 하에 완벽히 준수해야 합니다.
대한민국 금융당국의 정책 변경, 특금법 시행령 개정, 또는 해외 거래소의 한국인 대상 서비스 전면 철수 및 API 지원 중단 등 회사의 통제 범위를 벗어난 외부 사유로 인해 봇 구동이 불가능해질 경우, 회사는 즉시 서비스 제공을 중단할 수 있으며, 이로 인해 남은 라이선스 기간이나 매매 손실에 대해 보상할 의무가 없습니다.

Article 5 (Compliance with Regulations & Exchange Policies)

Because the Service relies on global exchange infrastructure, it may be interrupted by external factors.

The User must perfectly comply with the laws of their country and the Terms of Service, KYC, and Travel Rules of their chosen exchange.
If the Service becomes impossible due to changes in national financial regulations or if global exchanges terminate API support for specific regions, the Company may immediately suspend operations and is not obligated to compensate for remaining license periods or trading losses.

제 6 조 (지적재산권 및 불법 사용 엄금)

사용자는 회사로부터 정당하게 부여받은 라이선스(인증키)를 본인 명의의 계정에서 개인적인 자동 매매 목적으로만 사용할 수 있습니다.
금지 행위: 소프트웨어를 회사의 사전 서면 승인 없이 무단으로 복제, 배포, 양도, 상업적 임대 및 재판매하는 행위. 프로그램의 소스코드를 추출하기 위해 리버스 엔지니어링(Reverse Engineering), 디컴파일(Decompile), 크래킹(Cracking)을 시도하는 행위.

Article 6 (Intellectual Property & Prohibition of Illegal Use)

All copyrights and intellectual property rights related to the Service, including the software executable, UI/UX, trading logic, and source code, belong 100% to the Company.

Users may only use their legitimately granted license for personal automated trading on their own accounts.
Prohibited Acts: Unauthorized copying, distributing, transferring, commercial renting, or reselling of the software. Attempting to reverse engineer, decompile, or crack the program to extract source code.
If discovered, the Company will permanently ban the license and may pursue civil damages and criminal prosecution for copyright infringement.

제 7 조 (환불 규정)

본 서비스는 디지털 콘텐츠(소프트웨어)의 특성상, 사용자가 라이선스 키를 발급받아 봇 프로그램에 최초 로그인(인증)을 완료한 시점부터 디지털 상품의 가치가 훼손된 것으로 간주하여 어떠한 경우에도 환불이 불가합니다. (전자상거래법상 청약철회 제한 사유에 해당)
다만, 회사의 귀책 사유(서버 소스코드 오류 등)로 인해 서비스가 영구적으로 불가능해진 경우에 한하여, 남은 라이선스 기간에 비례하여 부분 환불을 진행할 수 있습니다.

Article 7 (Refund Policy)

Due to the nature of digital software, once the User receives a license key and completes the first login, the digital product is deemed consumed, and refunds are absolutely not permitted under any circumstances.
However, if the Service becomes permanently unavailable solely due to the Company's fault (e.g., critical source code failure), a partial refund proportional to the remaining license period may be provided.
